For brevity, facts are being taken from CWP-6979-2000.

The petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to promote the petitioner to the post of Hindi Teacher from the date her juniors were promoted.

Learned State counsel contends that the petitioner was not entitled to be promoted since she did not have the essential qualification of B.A. with Hindi as an elective subject. She had passed B.A. with Hindi as a compulsory subject. The issue already stands decided against the petitioners by this Court vide order dated 21.01.2004 passed in Civil Writ Petition No.1587 of 2000 titled Parveen Kumari and others v. State of Haryana and others. 4.

Learned counsel for the petitioner is not in a position to dispute these facts.

In view thereof, the claimed relief cannot be granted for want of essential qualification for the post, and the petition stands dismissed. 6.
