Learned counsel for the petitioner submits that due to dispute over the tenancy of father of petitioner with private respondents, they are posing threat to the lives and liberty of petitioner and her family members and have attacked them several times. She and her family members are not feeling safe while moving out and are always under apprehension that they may be caused injuries. Representations were made to the police several times but no action has been taken to provide security to their lives and liberty.

Without expressing any opinion on merits and keeping in view the fact that it is fundamental right of an individual to seek protection of his life and liberty granted by the Constitution, this petition is disposed of with direction to respondent No.3-Commissioner of Police, Ludhiana to look into Sachin Mehta 2017.05.12 17:35 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH

CRM-M-16895-2017 -2the grievance of petitioner regarding threat to her life and liberty and take appropriate action in accordance with law. However, for the injuries caused to the petitioner or any of her family member, separate remedy is available to the petitioner, which she may avail.

However, it is made clear that the above order will not be interpreted as providing protection to the petitioner from any legal action taken in any civil, criminal or any other proceedings initiated against her in accordance with law.
