SURINDER GUPTA, J.(Oral) This petition has been filed by petitioners namely Parvind Saroha and Sheetal, resident of Kurari Mohalla, Kalka seeking protection of their lives and liberty from the hands of private respondents No. 4 and 5, who are brothers of petitioner No. 2.

Learned counsel for petitioners submits that the petitioners are major and have married against the wishes of private respondents, who are annoyed on this score and are out to cause danger to their lives and liberty . He further submits that petitioner No. 2-Sheetal was earlier married to Gagandeep, resident of Amritsar but that marriage was dissolved by way of decree of divorcé dated 22.04.2013, copy of which has been placed on file as Annexure P-2. Petitioner No. 1-Parvind Saroha was also married with Bujesh, who had died on 22.01.2017. Though these facts were specifically mentioned in para No. 2 of the petition but by clerical mistake it was stated in Para No. 10 that it is the first marriage of both the petitioners, in fact it is their second marriage.

Without going into the merits of the submissions and keeping in view the fact that to seek protection of their lives and liberty is the fundamental right of the petitioners granted by the Constitution, this Jyoti 2017.05.12 12:57 I attest to the accuracy and integrity of this document

petition is disposed of with direction to Deputy Commissioner of Police, Panchkula to look into the representation (Anenxure P-7) and take appropriate action in accordance with law. While taking further action he may verify the factum of death of Bujesh wife of petitioner No. 1 Parvind Saroha.

However, it is made clear that nothing contained in this order shall be interpreted as giving protection to the petitioners against any legal action to be taken in any civil, criminal or other proceedings instituted/initiated/pending against them.
