The instant petition is for quashing of FIR No.75 dated 03.08.2011 registered under Sections 420, 467, 468, 471, 504, 1202B and 34 IPC at Police Station Odhan, District Sirsa and the consequent proceedings arising out of the same, on the basis of written compromise (Annexure P22) arrived at between the parties. Report has been received from learned JMIC, Dabwali after statements of the parties were recorded regarding the compromise. Learned JMIC, Dabwali has reported that the compromise is voluntary and without any pressure or coercion. Learned JMIC, Dabwali has also sent copy of the statements of parties.

Counsel for the petitioners contends that at the time of grant of anticipatory bail a sum of
11,00,000/2 was deposited with CJM, Sirsa under the orders of this Court and because the amount RAJ KUMAR 2015.12.14 17:06 I attest to the accuracy and integrity of this document


 

 



has been paid to the complainant as per compromise, the amount deposited with the CJM, Sirsa has to be returned to the petitioners and LRs of Jagtar Singh who was also accused in the case. The counsel refers to the statement given by the complainant2Baljit Singh before the court below in this regard.

Learned counsel for the State on instructions submits that respondent no.2 is the only aggrieved person in this FIR. No useful purpose would be served to keep the FIR pending.

 , the instant petition is allowed and the aforesaid FIR and all consequent proceedings conducted on the basis thereof are quashed qua the petitioners Needless to say that parties shall remain bound by the terms of compromise and their statements made in the Court below. The petitioners and the LRs of Jagtar Singh are entitled to the amount lying deposited as per compromise and they may approach CJM, Sirsa for withdrawal.
