VINOD S. BHARDWAJ , J (ORAL) Instant writ petition has been filed under Article 226 of the Constitution seeking a writ of mandamus directing the respondents not to terminate the services of the petitioner till regular candidate joins duty. It is apparent from the perusal of the paper book that notice of motion in this case was issued by this Court on 03.06.1996 and thereafter vide order dated 23.09.1996, matter was admitted. No interim order has been passed by this Court. It is informed by the Registry that learned counsel for the petitioner is reported to have since expired.

Learned State counsel informs that a number of Regularization Policies thereafter have been notified by the State of Haryana and there is every probability that the services of the petitioner may have been regularized. In case, services of the petitioner have already been discontinued for want of an interim order of this Court, in such circumstances, in the absence of any challenge to the said order of removal, no subsisting cause of action survives. Having heard learned State counsel and considering from either of the perspectives, it seems that there would be no existing cause of action to continue with the present petition.

CWP No.8508-1996 Accordingly, petition is dismissed for non-prosecution leaving the petitioner at liberty to seek revival of the present writ petition, in case she still has any subsisting and enforceable right.
