(ORAL) Matter was taken up for hearing on 16.01.2023, when learned counsel appeared out of professional courtesy and stated that learned counsel, who filed the instant appeal, has since been elevated to the Bench of this Court and was not able to assist this Court for not having power of attorney on record. In the premise, Registry was directed to issue notice to appellant. Needful has been done.
Office report reveals that notice issued to appellant has been received back unserved for want of complete address. In the premise, for lack of address, any further issuance of notice would be an exercise in futility. Learned counsel for respondent is also not aware of latest address of appellant.
