(Oral) This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.116 dated 08.04.2015 registered under Sections 406, 498-A, 377, 323 and 506 of Indian Penal Code at Police Station Sector 31, Faridabad, Haryana. Notice of motion was issued in the case on 26.05.2015 and thereafter, vide order dated 29.05.2015, parties were directed to appear before the Mediation and Conciliation Centre of this Court to explore the possibility of settlement. Criminal Misc. No. M-16894 of 2015 settlement arrived at between the parties is also on record. As per terms and conditions of the settlement, the accused party has to pay an amount of `12 lacs as full and final settlement to the complainant qua to claim of permanent alimony including past, present and future maintenance. It is also settled that all cases pending between the parties will be withdrawn. A petition under Section 13-B of the Hindu Marriage Act, 1955 has also been filed for dissolution of marriage with mutual consent wherein first motion statement has been recorded. Learned counsel appearing for the complainant submits that the complainant has no objection in case, the petitioner is granted anticipatory bail.
Since the dispute between the parties has been settled during pendency of this petition and both the parties have undertaken to comply with the terms and conditions of the settlement, the present petition is allowed and the petitioner (Ankur Saxena) is directed to be released on bail to the satisfaction of Illaqa Magistrate/Chief Judicial Magistrate, Faridabad.
