After hearing learned counsel for the parties and going through the police record, it transpires that the cheques of PUNGRAIN got signed from Deputy District Manager, were actually in joint possession of petitioner and Vishwa Mitter. A cheque of sum of Rs. 2.45 lacs, on the basis of fake name of Dilbag Singh was got deposited in the account of Dilbag Singh, who is untraceable till date. As per the bank account it was some fake Vishwa Mitter, who had identified Dilbag singh. Counsel for the petitioner has submitted that since the signatures on the cheque are of Deputy District Manager and the petitioner is not connected with Dilbag Singh, he may be granted the concession of pre-arrest bail. The petitioner remained absent after registration of the FIR.

The cheque in the name of Dilbag Singh was in the hand writing of the petitioner, as per statement of PW Gurmeet Singh Sr. Auditor in PUNGRAIN. The circumstances, indicate that not only the needle of suspicion points towards the petitioner but the conduct of the petitioner and other circumstances, also point towards the culpability of the petitioner. No ground is made out to grant the concession of pre-arrest bail to the petitioner.

Dismissed.
