Prayer made in the present case is for quashing the order dated 04.11.2003, whereby the application for grant of compassionate appointment to the petitioner, whose father, working as a Peon in Printing and Stationery Department, Haryana, died in harness on 15.09.2003, was rejected and further directing the respondents to provide suitable employment to him. 2.

The premise to reject the claim was that as per Rule 3(d)(iii) of Haryana Compassionate Assistance to the Dependants of Deceased Govt. Employees Rules 2003, which defines "deceased Government employee" as one who should not have crossed the age of 55 years, whereas the father of the petitioner died at the age of 59 years and therefore the benefit cannot be granted to him, however, he, in terms of the Haryana Compassionate Assistance to Dependent of deceased Govt. Employees (Amended) Rules, 2004 though was considered but being overage, was denied and subsequently, his mother was informed vide letter dated 24.12.2004 to apply for Ex-Gratia DINESH 2024.09.12 00:08 I attest to the accuracy and integrity of this document

CWP-14832 of 2004 (O&M) Financial Assistance, whereafter she having done so, was released an amount of Rs. 2.5 lac, relevant para of the written statement in this regard reads thus: "2. It is also submitted that respondent No.3 informed the mother of the petitioner vide letter No. P&SH-2004/11132/Admn., dated 24.12.2004 (R-1) & letter No. P&SH-05/777/Admn., dated 18.05.2005 (R-2) to submit an application for ex-gratia financial assistance. She has applied for the ex-gratia financial assistance during the pendency of present petition (R-3). The amount for financial assistance is being provided from FD vide letter No.P&SH-2005/58/Account, dated 01.07.2005 (R-4)."

In view of the above, nothing survives in the present petition, which is thus dismissed.
