Jaswant Singh,J(Oral) Petitioner was a member of Punjab Civil Medical Service being a qualified MBBS Doctor. He was suspended and a departmental enquiry for imposition of major penalty under Rule 8 of the Punjab Civil Services (Punishment and Appeal)Rules,1970 was initiated. After the enquiry officer had concluded the enquiry a fresh enquiry was ordered against the petitioner vide impugned order dated 15.5.1997.
This Court while issuing notice of motion vide order dated 27.5.1997 had stayed the conduct of fresh enquiry. Thereafter the writ petition was admitted vide order dated 19.11.1997. At the time of hearing learned counsel for the petitioner submits that her client has since retired on attaining the age of superannuation on 31.12.2009 and all the retiral benefits including for the RAJINDER PRASHAD JOSHI 2016.07.13 11:59 I attest to the accuracy and integrity of this document
CWP 7484/1997 period of suspension have since been released and he does not wish to pursue the present writ petition. She thus prays for withdrawal of the writ petition.
Learned State counsel has no objection to such a request made by the learned counsel for the petitioner.
