***** RUPINDERJIT CHAHAL , J (ORAL) Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short "BNSS"), the petitioner seeks anticipatory bail in case FIR No.106 dated 28.09.2023 registered under Sections 420 and 406 of IPC, registered at Police Station City-2, Malerkotla, District Malerkotla.

This Court vide order dated 01.04.2026 has directed the petitioner to join the investigation within a week and to cooperate with the investigating agency.

At this juncture, learned State counsel, on instructions from investigating officer, has submitted that the petitioner has not joined the investigation in terms of the order dated 01.04.2026, as directed by the Court and prays that the present petition be dismissed. Learned counsel for the petitioner has submitted that the petitioner has not joined the investigation due to some unavoidable circumstances.

Inspite of a clear direction issued by this Court to join and cooperate with the investigation, the petitioner has failed to comply and has willfully avoided participation in the proceedings. Such conduct demonstrates a lack of bona fides and undermines the investigative process. Grant of anticipatory bail is a discretionary relief, contingent upon the applicant's willingness to cooperate with law enforcement; the petitioner's non-compliance reflects an attempt to evade due process. In these circumstances, no ground is made out for extending the extraordinary protection of anticipatory bail, and the petition is accordingly dismissed.
