Petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.323 dated 24.07.2014 under Sections 379 IPC (Sections 420, 467, 468, 471 and 120-B IPC added later on), registered at Police Station Sector-5, Panchkula. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that as per allegations in the FIR, the car of the complainant was stolen by some unknown person and as per prosecution version, accused has been nominated on the basis of disclosure statement suffered by co-accused Upkardeep alias Prince. There is also allegation that number plate was tampered with and the car was put on sale, which was later on recovered from a village in Punjab. CRM No.M-17914 of 2016 -2Sessions Judge, Panchkula by learned Public Prosecutor that two more cases of same nature are pending against the petitioner and he is the member of an organized gang.

Keeping in view the facts and circumstances of the present case and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where petition is entitled to benefit of anticipatory bail.

Therefore, finding no merit in the present petition, the same is dismissed.
