This is a petition for quashing of the FIR. On asking of the court, counsel for the petitioner informs that the prosecution agency has not till date presented challan against the petitioner. As the allegations against the petitioner are still under investigation, it cannot be said at this stage whether the allegations stand substantiated by any material. This petition is disposed of as pre-mature with liberty to the petitioner to avail the appropriate legal remedy, in case the prosecution agency, on the basis of material gathered against the petitioner, forms an opinion to present challan.
