SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

On 24.03.2021 this Court passed the following order:- "The Court has been convened through video conferencing due to Covid-19 Pandemic.

Instant petition has been filed under Section 438 of Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 17 dated 20.02.2021, under Sections 307, 323 and 34 of Indian Penal Code, 1860 and 25 and 27 of Arms Act, 1959, registered at Police Station Cheema District Sangrur.

Counsel for the petitioner contends that the allegation against

{2} the petitioner is of giving stick blow to the father of the complainant, who ducked and saved himself. The other allegation against the petitioner is of instigating his father, Sukhwinder Singh @ Sukhdev Singh @ Sukha, who is alleged to have used a fire arm and shot at the complainant. Counsel further submits that the disputes between the parties have been settled and petition (CRM-M-12223-2021) has been filed for quashing of the FIR on the basis of the compromise, in which notice of motion has been issued by this Court for 12.07.2021. Notice of motion.

On asking of the Court, Mr. Ramandeep Sandhu, Senior Deputy Advocate General, Punjab accepts notice on behalf of respondent-State.

List on 12.07.2021.

To be heard along with CRM-M-12223-2021.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, he shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. He shall also abide by the conditions as specified under Section 438 (2) Cr.P.C."

Learned State counsel, on instructions from ASI Chamkaur Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation and he is not involved in any other case.

{3} He has further instructions to submit that no injury has been attributed to the petitioner and two injuries suffered by the father of the complainant, which have been attributed to the father of the petitioner, have been declared to be simple.

In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 24.03.2021 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
