The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in private complaint No.176/1/06 instituted on 15.6.2006, titled as "Jarnail Ram Versus Chetan and others", which has since been withdrawn by the complainant/respondent No.2 on 31.3.2012. Notice of motion has been issued in this case. Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.
It is argued that the petitioner was declared proclaimed offender HARPAL SINGH PARMAR 2016.07.27 10:22 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-17947 of 2016 (O&M) [2] in private complaint, which has already been withdrawn by the complainant, but as the petitioner has been declared proclaimed offender, therefore, the petitioner is apprehending his arrest.
Keeping in view the facts and circumstances of the present case and in view of the fact that the complaint in which the petitioner has been declared proclaimed offender has already been withdrawn and the petitioner is no more required for facing the trial in the proceedings, therefore, the interim order dated 23.5.2016 passed by this Court granting interim bail to the petitioner is made absolute.
