# Learned counsel for the petitioner faced with the query if the petitioner has availed of the remedy under the provisions of Sections 239/245 Cr.P.C. has made a statement withdrawing the present petition, however reserving rights of the petitioner to rake up all these pleas before the trial Court for discharge of the petitioner. He has further prayed that his application (Annexure P7) to this effect has never been considered by the trial Court till date.  As prayed, the petition stands dismissed as withdrawn with liberty aforesaid. The trial Court is directed to immediately consider and decide the application (Annexure P7) of the petitioner within the framework of law. However, it is made clear that the trial Court shall first decide the application before proceeding ahead into the matter. "
