The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 09.09.1993 (Annexure P-1) to the extent he has been regularised as Mali-cumChowkidar instead of Water Meter Reader. 2.
The petitioner joined respondent-Haryana Urban Development Authority as daily wager. He worked till 1993 and respondent by order dated 09.09.1993 regularised him as Mali-cum-Chowkidar. He claims that he should be regularised as Water Meter Reader instead of Mali-cumChowkidar. CWP No.6121 of 1999(O&M) -- against a sanctioned post nor after following the procedure prescribed for regular appointment. Nevertheless, as per Policy of the State Government, he was regularised vide order dated 09.09.1993. In the letter of regularisation, it was categorically mentioned that he is regularised as Malicum-Chowkidar. 3.
The respondent in its reply has categorically stated that petitioner from March'1987 to July'1989 worked as Beldar, from May'1987 to November'1992 as Water Meter Reader and from August'1989 to March'1993 as Mali-cum-Chowkidar. In this way, there would be overlapping of period and nature of job. He worked for 41 months as Malicum-Chowkidar whereas worked as Water Meter Reader for 22 months. He has retired on attaining the age of superannuation on 31.05.2016 as Water Pump Operator. The post of Water Meter Reader as well as Mali-cumChowkidar was Class-D post. The appointment letter specifically provided that he would be regularised as Mali-cum-Chowkidar. This Court does not find any ground to interfere with the impugned order. 4.
