Mr.Kirat Singh Sidhu,DAG Punjab assisted by ASI Harinder Singh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to accused petitioner Manjinder Singh @ Pretty in case FIR No.24 dated 2.5.2016 under Section341,323,148,149 IPC and 25,27 of the Arms Act,1959,PS Sadar,Faridkot.
It is in the backdrop of a previous scuffle between complainantKhushwant Singh @ Dhoota and non-applicant co-accused Harmel Singh that an occurrence on 1.5.2016 at around 5.30 pm took place between two groups. Co-accused Harmel Singh alongwith four co-accused including petitioner is alleged to have arrived in a i20 Car fully armed and on raising of lalkara by Harmel Singh launched an attack on complainant Khushwant Singh who suffered 9 injuries.
In the said occurrence co-accused Harmel Singh has suffered three injuries including incised wound on the front side of head. Petitioner accused is alleged to be armed with an iron Khanda RAJINDER PRASHAD JOSHI 2016.06.02 17:29 I attest to the accuracy and integrity of this document
CRM-M 17974/2016 and is alleged to have struck from the reverse side on the head of complainant and on the right arm.
It is not in dispute that these two injuries out of 9 are main injuries. It is contended that co-accused Harmel Singh has been granted interim protection.
At the time of hearing,learned counsel for the parties state that present petition has become infructuous since the petitioner accused stands arrested.
