**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioners seek pre-arrest bail in FIR No. 77 dated 22.3.2015 under Sections 406/420/120-B IPC, registered at Police Station Dakha, District Ludhiana.

Notice of motion was issued and interim protection was granted.

Learned counsel for State, on instructions from ASI Gulzar Singh, submits that in compliance of the order dated 31.7.2015 passed by this Court, petitioners have joined the investigation and they are no more required for the purpose of any further investigation.

However, learned counsel for the complainant vehemently contended that since the petitioners have not returned the huge amount of the complainant, they are not entitled for the concession of anticipatory bail. Criminal Misc. No. M-17030 of 2015 Having heard the learned counsel for the parties, after careful perusal of the record of the case and giving thoughtful consideration to the rival contentions raised, this Court is of the considered opinion that in the given fact situation of the present case, petitioners have been found entitled for the concession of anticipatory bail. It is so said, because in compliance of the order passed by this court, petitioners have joined and cooperated with the investigating agency. Further, learned counsel for the complainant has not alleged any misuse of the concession of interim anticipatory bail granted to the petitioners.

In view of the above and without commenting anything further on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is allowed and order dated 25.5.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C. Disposed of, accordingly.
