Through the instant writ petition, the petitioner/workman has sought quashing of the order dated 05.01.2001, whereby, despite having been regularized vide order dated 22.08.1996, he was treated as a workcharged employee. A further prayer has been made for issuance of directions to the respondents to permit the petitioner to continue to discharge his duties as a Special Dozer Operator, i.e., the post on which he stood regularized. 2.

The instant writ petition was instituted in the year 2021, and the operation of the impugned order(s) was stayed vide order dated 16.03.2001. 3.

On 01.10.2025, this Court passed the following order:- <Through the instant petitions, a prayer has been made for issuance of a direction upon the respondents to allow the petitioners to continue to discharge their duties as Special Dozer Operators, on the post, on which they stood regularised, till the incumbent junior to them have been continuing. At the time of issuance of notice of motion the operation of impugned order, was ordered to be stayed, and this petition has been pending since 2001, before this Court.

CWP-3513-2001 (O&M) In order to ascertain, whether the cause of action still survives, or not, the respondent-State is directed apprise this Court about the service status of present petitioners, by way of filing a specific affidavit.

Today, learned State Counsel, on instructions received from Mr. Gagandeep Singh, Executive Engineer (XEN), has informed the Court that during the pendency of the instant writ petition, the petitioner passed away. It has further been stated that immediately thereafter, the petitioner9s family was extended the benefit of family pension with effect from the date of death, along with release of all other retiral dues. Moreover, the petitioner9s son, namely Paramjit Singh, was granted employment on compassionate grounds in the year 2012.

In view of the submissions (supra), learned senior counsel for the petitioner submits that the grievance of the petitioner stands redressed and, accordingly, he does not wish to press the instant writ petition. 6.

Consequently, the instant writ petition is dismissed, as not pressed.
