Mrs. Amarjeet Kaur Khurana, Addl.A.G, Punjab. AJAY TEWARI, J (ORAL) This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case F.I.R. No.54 dated 09.3.2015 registered under Sections 420/427/447/120-B IPC at Police Station Cantonment, District Amritsar City.

On the last date of hearing i.e 25.05.2015, the following order was passed:- "Contends that the sale deed was executed for a plot measuring 160 sq. yards. The allegation against the petitioner is that he ought to have sold the entire plot of 170 sq.yards. Further contends that the dispute has been raised after a lapse of two years of the execution of the sale deed.

Notice of motion for 13.8.2015.

In the meantime, the arrest of the petitioner shall remain stayed subject to the following conditions :- i) He will make himself available for investigation as and when required to do so.

ii) He will not leave the country without the prior permission of the Court.

iii) He will not directly or indirectly make any inducement, threat or promise to any person

CRM-M- 17069 of 2015 #2# acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police official."

Today the learned State counsel, on instructions from HC Sukhwant Kumar has stated that the petitioner has joined the investigation and he is no more required for custodial interrogation. In the circumstances, the interim order dated 25.05.2015 is made absolute.

Petition stands allowed.

Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of. August 13, 2015 (AJAY TEWARI) manoj JUDGE
