***** GURVINDER SINGH GILL, J.(Oral) Having regard to the nature of allegations and the conduct of petitioner as has been noticed by this Court in order dated 13.8.2020 passed in CRM-M-21582 of 2020 (Annexure P-5), this Court does not deem appropriate to grant regular bail to the petitioner. Learned State counsel has informed that as on date only 8 out of the cited 22 PWs have been examined and that the next date fixed before the Trial Court is 16.4.2022.

The prosecution is directed to ensure the presence of the PWs before the trial Court on the dates as may be fixed by the trial Court for recording prosecution evidence. The trial Court shall frame a schedule of dates in advance for calling the witnesses and shall also endeavour to record PANKAJ KAKKAR 2022.03.31 17:15 I attest to the accuracy and authenticity of this document

( 2 ) CRM-M-12593-2022 (O&M) the statements of the PWs, whose presence is duly secured. Special Messengers be deputed for securing the presence of the PWs. If being necessary, a letter may be written to the Superintendent of Police, concerned, for doing the needful for ensuring timely presence of PWs. The District Attorney, concerned to also look into the matter for the purpose of securing the presence of the remaining PWs.

Needless to mention, in case there is inordinate delay in conclusion of trial, it shall be open to the petitioner to approach this Court again seeking grant of regular bail.
