The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.41 dated 28.9.2013 registered for the offences under Sections 325 and 34 IPC at Police Station Samalsar, District Moga.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the petitioner absented himself from the Court proceedings on 27.8.2014 and then was summoned through nonbailable warrants and ultimately he was declared proclaimed person on 18.2.2015. The petitioner has not surrendered before the trial Court, rather, has filed this petition for anticipatory bail. Learned counsel for the petitioner also stated that the petitioner has gone to Dubai, but at the same time, he admitted that the petitioner has Harpal Singh Parmar 2017.05.19 16:14 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-17139 of 2017 [2] not taken the permission of the Court for visiting foreign country. Keeping in view the fact that the petitioner has not shown any ground for absence for such a long period from the proceedings and further he has already been declared proclaimed person, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
