(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner, in case FIR No. 17 dated 01.07.2018 registered under Sections 21, 25 and 29 of the NDPS Act and Section 25 of the Arms Act at Police Station State Special Operation Cell, Amritsar.

According to the prosecution, on the basis of secret information, co-accused of the petitioner, namely; Tarvinder Singh, Sukhraj Singh @ Raja, Bikramjit singh @ Bikkar, Gurlal Singh and Sarabjit Singh, were arrested on 01.07.2018 and 14 Kg 800 grams of heroin was recovered from Sukhraj Singh @ Raja. One pistol .30 bore and two cartridges were recovered from Tarvinder Singh. During their interrogation and further investigation, name of the petitioner surfaced as a smuggler of heroin in league with Pakistani smuggler, namely; Arif @ Shah, Dodhi and BSF officials.

CRM-M-10264-2019 -2named in the FIR. He was not apprehended at the spot. He has falsely been implicated in the instant case. None of the co-accused of the petitioner has named him as their co-accused. Petitioner is innocent. Considering the seriousness of allegations levelled against the petitioner and the fact that several other persons are indulged in smuggling of narcotics, in connivance with smugglers of Pakistan and BSF officials etc., this Court is not inclined to grant anticipatory bail to the petitioner. More so, drug trafficking in this Northern region of the country has increased manifold in the recent past and, thus, such type of crime has to be dealt with severe hands.

Dismissed.
