The petitioners, through the instant petition are seeking modification of order dated 09.09.2022 whereby Principal Judge Family Court, Ferozepur has allowed ad-interim maintenance of Rs. 4,000/- per month to petitioners i.e. Rs. 3,000/- per month to

-2petitioner No. 1(wife) and Rs. 1,000/- per month to petitioner No. 2 (minor son).

Learned counsel for the petitioners inter alia contends that Family Court has granted interim maintenance of Rs. 4000/- per month to the petitioners i.e. Rs. 3,000/- per month to petitioner No. 1(wife) and Rs. 1,000/- per month to petitioner No. 2 (minor son). The respondent is working in Reebok and he is having handsome income still the Family Court has awarded interim maintenance of just Rs. 4000/- per month. The cost of living is very high, thus, it is impossible to survive with meager amount of Rs. 4000/- per month. On being confronted with the fact that there is no documentary evidence before Family Court qua income of the respondent and maintenance awarded is ad interim, learned counsel for the petitioners submits that Family Court may be directed to finally adjudicate the matter in a time bound manner. The Family Court has awarded interim maintenance of Rs. 4000/- per month which is a meager amount, however, income of husband cannot be ignored. The Maintenance awarded is ad-interim maintenance and Family Court has yet to determine final maintenance.

The prayer of learned counsel for the petitioners deserves to be accepted and accordingly, Family Court is requested to expedite determination of final maintenance and preferably within three months from the next date fixed before the Family Court i.e.
