Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.210 dated 17.06.2016 under Section 302 IPC and Section 25 of the Arms Act, registered at Police Station Kundli, District Sonepat.
Notice of motion.
Mr.B.S.Virk, Deputy Advocate General, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the prosecution version, the petitioner is the main accused, who shot the brother of the complainant namely Jagbir @ Babbal on his back and bullet crossed from back to chest side and he died due to the Vineet Gulati 2017.05.26 17:03 I attest to the accuracy and authenticity of this document Chandigarh injuries.
CRM No.M-17152 of 2017 -2Keeping in view the nature and gravity of the offence and in view of the fact that petitioner is the main accused, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present case the same is dismissed.
As learned State counsel has stated that only two witnesses remain to be examined, therefore, learned the trial Court is directed to expedite the trial as the petitioner is in custody since 30.06.2016. The Investigating Officer/SHO concerned is directed to produce the remaining witnesses before the trial Court at the earliest, preferably on the next date.
