Petitioner has filed this third petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.106 dated 11.09.2013 under Section 15 of the NDPS Act, registered at Police Station Jodhan, District Ludhiana. Notice of motion.
Mr.V.P.S.Sidhu, Asstt. Advocate General, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. In the present case, 56 kgs. 400 grams of poppy husk has been recovered from the petitioner, which falls under commercial quantity. Section 37 of the NDPS Act bars the grant of bail to the accused in the case of commercial quantity. Further, the present petitioner was also declared Vineet Gulati 2017.05.26 17:03 I attest to the accuracy and authenticity of this document Chandigarh proclaimed offender.
CRM No.M-17155 of 2017 -2Therefore, finding no merit in the present case the same is dismissed. However, as the petitioner is in custody since 12.05.2016, therefore, the trial Court is directed to expedite the trial by giving short adjournments and if required, even day to day adjournments. The Investigating Officer/SHO concerned is directed to produce the witnesses before the trial Court at the earliest, preferably on the next date.
