The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of letter dated 31.01.2024 (Annexure P-6) whereby candidature of the petitioner for allotment of Retail Outlet Dealership has been rejected.

The petitioner pursuant to advertisement dated 28.06.2023 applied for Retail Outlet Dealership. The site advertised was "between KM stone 137 and 140 on NH-52 on RHS while moving from Hisar towards Rajgarh". The petitioner was having land which falls within advertised site, however, it comes within district Bhiwani. In the advertisement, name of District as well as location was disclosed. The advertised location falls within jurisdiction of District Bhiwani whereas respondents in the advertisement has mentioned District Hisar.

Mr. Sant Lal Barwala, Advocate, submits that land of petitioner falls within the advertised site, thus, respondents have wrongly rejected claim of the petitioner.

Mr. Raman Sharma, Advocate, who on advance notice is present in Court, accepts notice and waives service. 6.

Mr. Raman Sharma submits that as per Brochure, the petitioner could file representation within 10 days from the date of rejection of his candidature and he has already filed letter dated 08.02.2024 (Annexure P-7). The matter is under consideration and competent authority would look into the same and decide in totality within four weeks from today. 7.

Counsel for the petitioner agrees to the aforesaid arrangement. 8.

In the wake of statement of both sides, the petition stands disposed of.
