CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
None for the petitioners.
Mr. R.K.S.Brar, Additional A.G., Haryana.
*** ARUN MONGA, J. (ORAL) Vide this common order, I intend to dispose of the aforementioned three writ petitions, as common question of law and facts are involved therein.
When, matter was earlier heard on 16.01.2017, following order was passed:- "There are 15 petitioners in a writ petition bearing CWP No.13022 of 1992 and at one stage by order dated 22.08.2013 the petition was disposed off as having been rendered infructuous.
Thereafter, civil miscellaneous application bearing CM No.4137 of 2014 was filed for revival of the case and the same was revived by order dated 17.07.2015. Today, the learned counsel for the petitioners states that he is appearing only on behalf of the petitioner No.2. As per the record, the petition had been filed by Sh. Amarjit Singh, Advocate who is no longer in practice. In the circumstances, it would be necessary to issue notice to the petitioner No.1 and petitioners No.3 to 15. Learned Additional Advocate General points out that this petition was filed almost a quarter century ago when all these persons were in service and the addresses which have been provided in the memo of parties may not be correct. VANDANA 2022.04.05 03:54 I attest to the accuracy and authenticity of this document
In the circumstances, the duty now lies upon the surviving petitioner to ascertain the correct addressees of his co-petitioners so that notice can be issued to them. The respondents No.4, 5 & 6 were also represented by Sh. Surya Kant, Advocate as His Lordship then was. The surviving petitioner also has to ascertain the fresh addresses of respondents No.4 to 6 so that notice can be issued to them as well.
Let fresh notice be issued to the petitioners No.1 and 3 to 15 and respondent Nos.4 to 6 on filing of their fresh addresses by the surviving petitioner.
Adjourned to 09.05.2017.
A photocopy of this order be placed on the files of the connected cases."
When called out for hearing today, there is no representation on behalf of the petitioners. It seems that by sheer pendency of the writ petition for more than 29 years before this Court, either it has been rendered infructuous or even otherwise the petitioners seem to have lost interest in pursuing the same.
Be that as it may, writ petitions are disposed of with liberty to the petitioners to file an appropriate application in case, any cause of action still survives.
Photocopy of this order be placed on the connected case files. 31.03.2022 (ARUN MONGA) vandana JUDGE Whether speaking/reasoned:
