Mr. Varun Mittal, Advocate for respondent no.2. **** ANOOP CHITKARA, J. (Oral) Petitioner-complainant seeks cancellation of bail granted to respondent no.2-accused.
However, counsel for respondent no.2-accused submits that the bail granted to the respondent no.2 be not cancelled, though he would have no objection in case the Court imposes any stringent conditions. Considering the prayer made by the accused, this Court is not inclined to cancel the bail, subject to accused complying with the following conditions within 15 days from today:- (i) The petitioner shall not influence, browbeat, pressurize, make any inducement, threat, or promise, directly or indirectly, to the witnesses, the Police officials, or any other person acquainted with the facts and the circumstances of the case, to dissuade them from disclosing such facts to the Police, or the Court, or to tamper with the evidence.
(ii) Within fifteen days from today, the petitioner shall forward to the Investigator/SHO and the complainant/victim(s) the complete details of bank account numbers with addresses, fixed deposits, DEMAT account numbers, the current market value of jewellery, sovereign metals, all precious articles, held either individually or jointly, and cash-in-hand. It is clarified that in case the abovesaid directions are not complied within 15 days, it shall be permissible for the petitioner-complainant to file a fresh ASHWANI KUMAR 2023.03.
