**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.53 dated 02.07.2016, under Section 376 IPC and Section 4 of POCSO Act, 2012, registered at Police Station Woman Yamunanagar, District Yamunanagar.
Investigating officer has informed that after investigation the challan was presented on 04.08.2016 and the charges were framed on 18.08.2016. Out of total 16 witnesses, five witnesses have been examined so far.
After going through the statement of the victim recorded under Section 164 Cr.P.C., it transpires that she had accompanied the petitioner Manish with her own free will and with her consent. CRM-M-1728-2017 -2and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Jagadhri.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
