This is a petition that has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the respondent No.2 to decide the application dated 31.01.2022 (Annexure P-2) filed by the petitioner, as the petitioner is entitled to get the compensation under Haryana Victim Compensation Scheme, 2013 and under Section 357-A of the Code of Criminal Procedure. 2.

Learned counsel for the petitioner herein would contend that the petitioner would be satisfied if the application dated 31.01.2022 (Annexure P-2) submitted to respondent No.2 i.e. Secretary, District Legal Services Authority, Bhiwani is decided in a time bound manner. 3.

Notice of motion to the official respondents only. 4.

Mr. Vishal Malik, DAG, Haryana who is present through the medium of video conferencing, accepts notice for the official respondents and submits that the official respondents will look into the matter and will take a decision on the application of the petitioner. However, a perusal of the application dated 31.01.2022 (Annexure P-2) would show that it has been addressed to the Chairman, District Legal Services Authority, Bhiwani whereas direction is sought against Secretary, District Legal Services Authority, Bhiwani. It is not disputed that respondent No.2 is the authority competent to decide such a representation.

Without commenting on merits of the case, I dispose of the instant petition by directing the petitioner to make an appropriate application to respondent No.2 within a period of 10 days from today and the same will be decided by respondent No.2 in accordance with law expeditiously, preferably within a period of four months from the date of receipt of certified copy of this order and convey the decision to the petitioner.
