**** ANITA CHAUDHRY, J Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No. 40 dated 10.6.2015, registered under Sections 406, 498-A, 120-B IPC, Police Station Women Cell, Jalandhar. Counsel for the petitioner states that pursuant to the order dated 31.8.2018, passed by this Court, the petitioner has joined the investigation and his passport is already with the Court below. Counsel for the complainant submits that the petitioner has not paid any maintenance amount.

Counsel for the petitioner contends that the petitioner was abroad and he is not aware of any order and he had returned only in 2018. State counsel states that the petitioner has joined the investigation.

Crl. Misc. No. M-18186 of 2018 -2The matter was referred for mediation. Mediation has failed. Custodial interrogation of the petitioner is not required. Looking to the circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 31.8.2018 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.

The passport of the petitioner will remain with the trial Court till trial is over.
