ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 18.01.2023, when none appeared for the parties and Registry was asked to issue notice to the parties. Needful has been done.

Office report reveals that some of the parties have died while on the other hand, no one has put in appearance on behalf of appellants despite service. It appears that by sheer effluxion of time, since appeal has been pending for the past almost 28 years, parties to lis have lost interest to pursue the appeal, as neither anyone appears on behalf of the parties nor their legal representatives have taken any steps for their impleadment. In the premise, instant appeal is dismissed for nonprosecution with liberty to the appellants to file application in case any cause of action survives.
