Petitioner seeks concession of regular bail in a case registered against him under sections 376/34 IPC, section 3/4 of Protection of Children from Sexual Offences Act, 2012 and section 66/67-A of Information and Technology Act vide FIR No. 8 dated 07.02.2015 at police station Khuian Sarwar, district Fazilka. FIR was registered on the statement of Daya Rani. She stated that she was studying in 9th class in Government Senior Secondary School, village Maujgarh. During recess, when she was coming back after having water from the tap at that time, accused asked her to come to a room outside the school as they had to ask something. When she came inside the room, one of the accused shut her mouth while other one took off her clothes. Accused Sagar committed rape on the complainant while Bansi Lal (petitioner herein) and Mangu made movie on their mobiles of this sordid act. They, thereafter, threatened the complainant that in case this incident was disclosed to anybody, movie would be shown to the AJAY KUMAR 2015.08.20 15:10 I attest to the accuracy and authenticity of this document
CRM M-17255 of 2015 public. Petitioner has prayed for bail on the ground that no specific role is attributed to him. I am not convinced with this plea. In my considered view, allegations in the FIR are serious. Crime of this nature is on the rise which has to be curbed. There is no question of granting bail to the petitioner. Admittedly, complainant was minor at the time of occurrence. There is, thus, no merit in the petition. Dismissed.
