***** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.648 dated 20.08.2018, registered under Sections 332, 353, 186, 307 IPC and Section 61(1) of the Punjab Excise Act, 1914, Police Station, Sadar Palwal, District Palwal.

According to the prosecution, on 28.08.2018, petitioner was illegally transporting 45 boxes of wine, 16 boxes of beer and 24 boxes of liquor Marka Mastana in a vehicle bearing No.HR 29U 4297. When police party, on receipt of a secret information, chased him, petitioner hitting the police vehicle along with his co-accused, succeeded in running away.

Learned counsel for the petitioner contends that petitioner was not apprehended at the spot. There was no evidence with the police, showing complicity of the petitioner. Petitioner has falsely been SONIKA 2019.03.11 16:47 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-10383 of 2019 --2-- implicated in the instant case. Co-accused of the petitioner namely Dalbir has already been granted the concession of anticipatory bail by this Court vide order dated 04.02.2019 passed in CRM-M-44638-2018 (O&M). Treating the case of the petitioner on the same parity, he may also be granted the concession of anticipatory bail. The case of the petitioner cannot be treated at par with his coaccused Dalbir, inasmuch as, petitioner was carrying the aforesaid huge quantity of liquor, wine and beer, illegally without any permit or licence and on being chased by the police, he hit the police official vehicle and fled away.

His custodial interrogation is required to know the modus operandi and source from where such a huge quantity of liquor, wine and beer was procured by him and where it was to be sold and to whom.

Dismissed.
