Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 30 dated 9.2.2015 under Section 395, 427 of the Indian Penal Code, 1860 (Section 395 IPC was added later on and Section 392 IPC was deleted), registered at Police Station Shimlapuri, District Ludhiana.

Learned counsel for the petitioner has submitted that material witness Jagjit Singh son of Mewa Singh qua the petitioner has not supported the prosecution case during trial. Petitioner is in custody since 12.2.2015.

Learned State counsel, who is assisted by Assistant Sub Inspector Ram Singh, has opposed the petition but has not controverted the factual aspect of the submissions made by the learned counsel for the petitioner.
