Rajan Gupta, J (Oral) This is a second petition under Section 438 Cr.P.C seeking pre-arrest bail in a case FIR No.67 dated 13.3.2013 under Sections 420, 406, 467, 468, 471, 506, 120-B IPC registered at Police Station, Naraingarh, District Ambala.
Counsel for the petitioner has reiterated the arguments raised in the first bail application. According to him, there is no evidence on record to connect the petitioner with the crime. Heard.
It appears that petitioner earlier preferred a similar petition before this court, which was dismissed vide order dated 17.3.2015. Complaint was lodged by Devi Chand, who alleged that accused approached his family assuring that name of their son would be included in the Ranji Trophy and IPL list. Complainant deposited approximately about Rs.24,55,000/- in the bank after selling his ancestral property believing the assurance given by the accused. Name of son of the
CRM-M-17287 of 2015 2 complainant never figured in the list of any cricket match. He was duped lacs of rupees. Petitioner thereafter repeatedly moved pre-arrest bail applications before the Sessions Court. However, same were rejected. While dismissing the earlier bail petition, this court observed that custodial interrogation of the petitioner was required for the purpose of taking the investigation to its logical end. Commissioner of Police, Ambala was given liberty to appoint more competent officer to investigate the matter. It appears, however, petitioner is absconding from the process of law. As there is no change of circumstances, this petition is dismissed with Rs.50,000/- as costs. Commissioner of Police, Ambala shall send a report whether order dated 17.3.2015 has been complied with.
