This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 165 dated 05.03.2015 under Section 392 IPC at Police Station City Thanesar.

Learned counsel for the petitioner contends that petitioner has been falsely implicated. There is nothing to connect the petitioner with the crime. The car was handed over to HDFC bank. Thus, no case is made out qua the petitioner. Notice of motion.

On the asking of court, Mr. Kapil Aggarwal, Addl. A.G. Haryana, who is present in court, accepts notice on behalf of the respondent. He has opposed the plea. He submits that petitioner actively participated in the crime. A car was snatched by petitioner alongwith co-accused from the complainant at Pipli. His custodial interrogation is required for taking the investigation to its logical end.

CRM-M 17298 of 2015 FIR was lodged by Krishna Nand Pandit. He stated that he had gone to meet Gagan Chadha in District Jail, Kurukshetra. On the way back, he stopped at Pipli to have food. Thereafter, he slept in the car. After some time, accused came in a white car and caught hold of him. They snatched his vehicle alongwith `25,00/-, ATM card, voter card, PAN card, driving license and two mobile phones etc. and fled from the scene.

In view of nature of allegations, I am of the considered view that no case for grant of pre-arrest bail to the petitioner is made out. His custodial interrogation may be necessary for unearthing the entire modus operandi of the crime. Dismissed.
