(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner in case FIR No. 87 dated 18.09.2019 registered under Sections 406 and 420 IPC at Police Station Sadar, Rupnagar.

According to prosecution, petitioner played a fraud and cheated the complainant for certain amount, on the false pretext of settling him abroad. However, when the petitioner did not fulfill his promise, complainant lodged FIR, in which the petitioner compromising the matter with the complainant, agreed to pay `7,49,000/- to him, but did not pay.

Learned counsel inter alia contends that on the date of alleged fraud, petitioner was not present in India. At that time, he was in Italy. He has falsely been implicated in the instant case. CRM-M-9751-2020 -2Considering the overall circumstances and the fact that the human trafficking is on alarming increase in the State of Punjab by scrupulous elements like the petitioner, this Court is not inclined to differ with impugned order of the Sessions Court, rejecting bail application of the petitioner. Petitioner is necessarily required for custodial interrogation to un-earth the fraud and his modus operandi to cheat the complainant. Dismissed.
