This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.117 dated 4.5.2016 registered for the offences under Sections 323, 379-A, 506 and 34 IPC at Police Station Sector 18, Gurgaon City, District Gurgaon.
Notice of motion to Advocate General, Haryana. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Additional Advocate General, Haryana appearing for the respondent-State and have gone through the record. In the present case, FIR has been registered on the statement of Harpal Singh Parmar 2016.08.11 17:32 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-18286 of 2016 [2] Shimla Devi, who stated that Pawan Kumar came to her house. He was earlier having the grudge regarding her altercation with his mother. He gave slap blow to her. Thereafter, his both brothers started beating her. They snatched a ring from the finger and bite her finger. The present petitioner has been in judicial custody since 4.5.2016. He is not required for interrogation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
