Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to accused petitioner Lovedeep Singh @ Sunny in case FIR No.2 dated 6.1.2015 under Sections 21,29,61,85 of the NDPS Act,PS Garhdiwala,Distt.Hoshiarpur. There is alleged recovery of 5 grams of heroin from Gurvinder Singh and on his disclosure statement name of the petitioner accused has surfaced as supplier.

Since seized contraband being small quantity petitioner was released on bail on 27.7.2015. For his solitary absence during trial on 3.5.2016 his bail bonds have been cancelled and non-bailable warrants issued. The reason for non-appearance is wrong noting of the date. After hearing counsel for the petitioner and without going into sufficiency of the reason for non-appearance, it is deemed appropriate to dispose of this petition.

Keeping in view the totality of circumstances, it is ordered that in the event of petitioner surrendering before the trial court within 10 days from today, he shall be released on regular bail subject to furnishing of fresh bail bonds.

Allowed in the above terms.
