Petitioner-George Shubh, aged 45 years, has filed the instant petition for seeking direction to protect his life and liberty, which is stated to be at danger at the hand of respondents No. 4 to 9. 2.

Learned counsel for the petitioner submits that petitioner's real brother, namely, Robert Shubh, is married to respondent No. 4-Jyoti, who is presently settled in America and thereafter, he started having disputes with members of his in-laws' family. He further submits that though, there is no dispute directly with the petitioner, yet he was confronted with some unknown persons, who threatened him. Counsel further submits that his brother Robert Shubh has been receiving threat calls from Babbar Khalsa on his phone No. 0017179419687 from phone No. 0019808000001. 3.

Status report dated 19.09.2022 by way of an affidavit of Sukhninder Singh, PPS, Deputy Superintendent of Police, Sub Division Bholath, District Kaputhala has been filed by learned State counsel on behalf of respondents No. 1 to 3, which is already available on record. Registry is directed to tag the same at appropriate place in the file. 4.

As per said status report, the allegations were enquired into by the Deputy Superintendent of Police (investigation officer), District RIYA 2023.04.20 14:12 I attest to the accuracy and integrity of this document

CRWP-2647-2022 (O&M) -2- 2023:PHHC:055407 Kapurthala. Petitioner and the private respondents No. 4 and 5 and one Harbhajan Singh joined the enquiry and their respective statements were recorded. After conducting the said enquiry, report has already been submitted to the Senior Superintendent of Police, District Kapurthala, wherein it was found that there is no record available in regard to the phone No. 0019808000001 and as per allegations, it is the brother, who has been receiving the threat calls, after having dispute with his own in-laws. 5.

Broadly, Mr. Anmol Singh Sandhu, AAG, Punjab, apprised the Court that whatever the representations were submitted by the petitioner against respondent No. 4, same have already been examined and no substance of truth is found in the same to take any action. 6.

I have heard the petitioner as well as learned State counsel and perused the record available before me.

This Court is of the view that apprehension of the petitioner, as expressed by him in the representation(s) has already been examined, resulting into finding that there exists nothing substantial to take any legal action, therefore, present petition stands disposed of . 8.

However, it would be open for the petitioner to move a fresh representation alongwith the substantial material, in case, he receives any fresh threats.
