Prayer in this petition is for grant of pre-arrest bail to the petitioner in a case registered against him under sections 307/326/34 IPC vide FIR No. 57 dated 04.02.2018 at police station Basti Jodhewal, district Ludhiana. It has been urged before the court that petitioner has not caused any injury in the occurrence. According to learned counsel, no recovery is to be effected from the petitioner. Thus, he deserves the concession of prearrest bail. I have heard learned counsel for the petitioner and given careful thought to the facts of the case.
FIR was registered on the complaint made by Mohd. Kasim. He stated that on 04.02.2018 his younger brother Mohd. Shadam had gone out. At about 3.00 P.M. when he returned, he was bleeding profusely from his neck. On account of the injuries suffered, he became unconscious and fell on the floor. Thereafter, he was taken to Civil hospital from where he was referred to CMC hospital, Ludhiana. CRM M-18298 of 2018 suffered on the neck, his brother was unable to speak. After registration of FIR, investigation ensued and police recorded the statement of injured. He stated that due to monetary dispute with petitioner and co-accused Vikas, they attacked him and caused injuries on his neck. It is evident that injured who was sitting in the middle of the motorcycle was attacked by the accused. Petitioner is stated to be driving the motorcycle while the pillion rider inflicted grievous injury on the neck of injured. Keeping in view the nature of allegations and gravity of crime, I am of the considered view that petitioner is not entitled to concession of pre-arrest bail.
