Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Varinder Kumar in case FIR No. 14 dated 14.02.2019, registered under Section(s) 420, 193, 199 and 200 IPC at Police Station Khuian Sarwar, District Fazilka.
As per instructions from Assistant Sub Inspector Santa Singh, learned counsel for the respondent-State contended that petitioner joined the investigation but did not co-operate with the Investigating Agency and the relevant record was not produced by him and as such, there was no effective joining of investigation by him in this case. Criminal Misc. No. M-10366 of 2019 (O&M) police and for that purpose, he had also moved an application before the police on the basis of which Daily Diary Report was registered. Learned counsel for the respondent-State as well as the complainant contended that the said matter has already been looked into by the police and it was found that record was intentionally lost by the petitioner.
In view of above, no case is made out to grant the concession of pre-arrest bail to the petitioner and as such, present petition stands dismissed.
