**** ANOOP CHITKARA, J. (ORAL) I have heard learned Senior Advocate for the petitioner and learned counsel for the complainant for considerable time.
Prima facie the possibility of the entire matter being civil in nature apart from criminal cannot be ruled out.
At this stage, learned counsel for the parties also admit that the suit for specific performance is already pending between them. In the entirety of the facts and circumstances, the preset petition is allowed and the interim order dated 09.11.2021 is made absolute subject to the following further condition:
(i) Within fifteen days from today, the petitioner shall forward to the Investigator/SHO and the complainant/victim(s) the complete details of bank account numbers with addresses, fixed deposits, DEMAT account numbers, the current market value of jewelry, sovereign metals, all precious articles, held either individually or jointly, and cash-in-hand.
If the petitioner fails to comply with this condition, then on this ground alone, the bail might be cancelled, and the complainant may file any such application for the cancellation of bail, and State shall file the said application. It is clarified that Mr. Robin Gill, learned assisting counsel for the petitioner will apprise the petitioner that in case he does not disclose the true and complete facts then he can be held up for forgery.
