Through this petition under Section 439, Code of Criminal Procedure, the petitioner has sought regular bail in case FIR No.110 dated 4.5.2015 registered under sections 420/120-B IPC and 66-A of the Information Technology Act, 2000, at Police Station PGIMS Rohtak, District Rohtak (later on Sections 467/468 and 471 IPC were added). The allegations against the petitioner are that he along with his co-accused had leaked the question papers of All India Pre Medical Entrance Test Examination, 2015 to be held on 03.05.2015. Learned counsel for the petitioner contends that out of total 41, 39 accused have been granted regular bail by the court. The role of the petitioner in this case is akin to that of co-accused, who had already been enlarged on bail.

On the other hand, learned counsel for the State has vehemently opposed the prayer of the petitioner for grant of regular bail. Keeping in view the facts and circumstances of the case and Virender Kumar 2017.08.04 10:53 I attest to the accuracy and integrity of this document

CRM-M-17451-2017 2 also treating the case of the petitioner on the same parity as that of 39 coaccused, who have been granted bail, the petitioner is also admitted to bail during the pendency of the trial, subject to his furnishing bail bonds and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned. The petition stands disposed of accordingly.
