ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 12.04.2023, when none appeared for learned counsels for parties and Registry was asked to issue notice to parties. Needful has been done.
Office report reveals that appellants have died. However, notice issued to respondent has been received back with the report that he is not residing at the given address. Since legal heirs of deceased appellants have not taken any steps to implead themselves, it seems that by sheer effluxon of time as the appeal is pending before this Court for the past more than 29 years, they have lost interest in pursuing the same. Issuance of fresh notice to respondent would also be an exercise in futility as his correct address is not available on record. In the premise, instant appeal is dismissed in default.
