NAMIT KUMAR J. (Oral) The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing respondents No.1 and 2 not to promote respondent No.3 as Superintending Engineer with the help of reservation policy and to consider the petitioners for promotion against the vacant post of Superintending Engineer on the basis of Punjab Government Instructions dated 12.07.1995. Further a writ of certiorari has been sought for quashing the order dated 25.02.2000 (Annexure P-2). Since there was no representation on behalf of the petitioners and respondents No.2 and 3, notices were ordered to be issued to them.

CWP No.7540 of 2000 (O&M) As per office report, petitioners No.1 and 2 have been served. Notice issued to respondent No.3 has been received back unserved with the report "not found at the given office address". Learned counsel for respondents No.2 and 3 submits that during the pendency of the present petition, petitioners No.1 and 2 have retired from the post of Superintending Engineer on 31.08.2008 and 28.02.2007, respectively and respondent No.3 was promoted as Superintending Engineer in the year 2001 and retired on 31.07.2014 and he was also given charge for the post of Managing Director of Punjab Water Supply and Sewerage Board, Chandigarh and therefore, the instant petition has been rendered infructuous. Disposed of as having become infructuous.
