SUDIP AHLUWALIA, J. (ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.87, dated 4th July, 2017, registered under Sections 302, 201, 365 & 34 of the Indian Penal Code, at Police Station Sector 9-A, Gurugram. 2.

The Petitioner has remained in custody for 31⁄2 years since 9th September, 2017.

Attention of the Court is drawn to the order passed by a Coordinate Bench of this Court in CRM-M No.40310 of 2019 on 18th June, 2020 (Annexure P-2) vide which co-accused Kunal @ Golu was granted Regular Bail.

The role attributed to the present Petitioner in the case is virtually identical with that of the said co-accused namely Kunal @ Golu. DEEPAK KUMAR 2021.04.06 19:04 I attest to the accuracy and integrity of this document

CRM-M-14085-2021 -2The detention suffered by him till now is much more than co-accused. 5.

As many as thirteen witnesses from the Prosecution side are still remaining to be examined.

As such, without commenting any further on the merits of the present case as a whole and in view of the long detention undergone by him, the prayer of the Petitioner for Regular Bail is allowed and he is ordered to be released on bail, subject to appropriate term and conditions to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned. 7.

Disposed off.
